HC directs equal pension to widow, child from 2nd wife

Panaji: The Bombay high court has directed that the first wife of a deceased govt employee and his child begotten from his second wife be entitled to 50 per cent each of his family pension. The HC directed that pension under the Central Civil Services (Pension) Rules, 2021 be paid in proportion of 50 per cent to his first wife of the deceased govt employee and the other 50 per cent to his child from his second wife.The deceased employee’s first wife, a senior citizen, went to the high court seeking family pension. The govt said it was unaware about the existence of his first wife.She did not dispute the fact that the child begotten from the second wife was his biological child. The HC directed the govt dept to process the papers for family pension and forward this to the deputy director of accounts (Pension section) within 4 weeks.. The HC clarified that if any pension, in excess of the 50 per cent, has been paid to the child, the accounts department should not seek a refund.Instead since no pension has been paid since Nov 2025, the HC directed the department to adjust such excess amount and make payment after adjustment directly to the child through her mother.
