Panaji: The Bombay high court has restrained developers of a residential project at Candola, Ponda, from creating any third-party rights in flats on the third and fourth floors until the next hearing.Advocate Gaurish Agni, appearing for the respondents, told the court on instructions that they would not execute any fresh agreements or create third-party rights in the apartments on the two floors.The division bench of Justice Valmiki Menezes and Justice Amit S Jamsandekar accepted the statement as an undertaking and ordered that the restraint would operate on the respondents.The order came on a PIL filed by Shantadurga Devlay Residents Association, Candola, and Goa Foundation challenging construction of a ground-plus-four-floor building with 20 flats.Goa Foundation said the project was initially granted technical clearance by town and country planning department on June 23, 2025, for a ground-plus-one-floor building with four flats.The permission was revised on Jan 19, 2026, allowing enhanced FAR and additional building height under the amended Goa Land Development and Building Construction Regulations, 2010. The revised plan permits 20 flats across five floors.The foundation said construction had progressed to the upper floors despite a pending challenge to the regulatory amendments. It said the Candola case forms part of a wider challenge before the high court over enhanced FAR and building height allowed under the amended regulations.
